Introduction
Welcome to My Digital Diary. These Terms of Use ("Terms") govern your access to and use of the My Digital Diary website, application, and related services (collectively, the "Service"). My Digital Diary is designed to help individuals organise, plan, record, and manage different aspects of their personal and professional lives. By creating an account, selecting an option indicating your agreement, or using the Service after being presented with these Terms, you agree to be bound by them. Please read these Terms carefully before using the Service. If you do not agree, you should not create an account or use the Service. Your use of My Digital Diary is also subject to our Privacy Policy, which explains how we collect, use, protect, and process personal information. Nothing in these Terms limits any consumer, privacy, or other legal rights that cannot lawfully be excluded.1. About My Digital Diary
My Digital Diary is a personal planning, productivity, record-keeping, and life-management platform. Depending on your subscription and available features, the Service may include:- Daily planning and task management.
- Annual planning and personal goals.
- Financial tracking and reporting.
- Budgeting, savings, and debt management.
- Health and wellbeing records.
- Exercise, diet, and sleep tracking.
- Personal notes and productivity tools.
- Meetings, calendars, and reminders.

- Relationship and networking records.
- Business cards and contact management.
- Document storage and electronic signing.
- Personalised reports and exports.
- AI-assisted planning and insights.

2. Eligibility and Account Registration
To create an account, you must have the legal capacity to enter into these Terms under applicable law or have any legally required parent or guardian authorisation. You agree to provide accurate, current, and complete information when registering and to update that information when necessary. You must not impersonate another person, create an account using false information for fraudulent purposes, or use another person's account without authorisation. We may require account verification or additional information where reasonably necessary to protect the Service, prevent fraud, or comply with the law.3. Your Account and Security Responsibilities
You are responsible for taking reasonable steps to protect your account and login credentials. You agree to:- Use a strong and unique password.

- Avoid sharing your account with unauthorised persons.
- Use available security features appropriately.
- Notify us promptly of suspected unauthorised access.
- Keep your account recovery information up to date.
4. User Content and Ownership
My Digital Diary allows you to create, upload, record, store, and manage personal information, documents, notes, recordings, and other content ("User Content"). You retain ownership of your User Content. These Terms do not transfer ownership of your personal information, diary records, documents, or original content to My Digital Diary. You grant us a limited, non-exclusive, worldwide, royalty-free permission to host, store, reproduce, organise, process, transmit, and display your User Content only as reasonably necessary to:- Provide the Service and features you request.
- Maintain and secure your account.
- Generate requested reports and summaries.
- Perform authorised backups and recovery.
- Support integrations you enable.
- Comply with applicable legal obligations.
5. Your Responsibilities for User Content
You are responsible for ensuring that the information and materials you enter or upload are lawful and that you have the necessary rights or permissions to use them. You must not knowingly upload, store, or distribute content that:- Violates applicable laws.
- Infringes another person's intellectual property rights.
- Unlawfully violates another person's privacy.
- Contains malicious software or harmful computer code.
- Is intended to facilitate fraud or unlawful activity.
- Is created through unauthorised access to another person's information.
- Is otherwise prohibited by these Terms or applicable law.
6. Personal and Sensitive Information
My Digital Diary may allow you to store confidential information about your finances, health, relationships, beliefs, family, and personal activities. You decide which information to enter into the Service, subject to applicable legal requirements. You should carefully consider the sensitivity of the information you choose to store. We handle personal information in accordance with our Privacy Policy and applicable data protection laws, including Uganda's Data Protection and Privacy Act, 2019, and the Data Protection and Privacy Regulations, 2021. Where sensitive personal information requires additional consent or safeguards, the relevant legal requirements will apply. You should not enter another person's sensitive information unless you have the necessary legal authority or consent.7. AI-Powered Features
My Digital Diary may offer artificial intelligence features, including the AI Planner, personalised insights, activity summaries, and planning recommendations. AI features may process relevant information that you provide or authorise for the purpose of generating requested responses. Where third-party AI services are involved, relevant information may be processed by those providers in accordance with applicable terms, privacy protections, and legal requirements.7.1 Accuracy of AI Outputs
AI-generated responses may contain errors, omissions, outdated information, incorrect calculations, or inappropriate recommendations. AI outputs should be treated as assistance for planning and decision-making rather than guaranteed statements of fact. You should independently verify important information before relying on it.7.2 Professional Advice Disclaimer
AI-generated content does not constitute professional advice from a qualified:- Financial adviser.
- Accountant or auditor.
- Doctor or healthcare professional.
- Lawyer.
- Psychologist or counsellor.
- Investment adviser.
- Tax professional.
- Other regulated professional.
7.3 Third-Party AI Credentials
Where the Service permits you to connect your own OpenAI, Anthropic, or other supported API credentials, you are responsible for:- Maintaining the relevant provider account.
- Complying with the provider's applicable terms.
- Monitoring your API usage.
- Paying applicable provider charges.
- Protecting your credentials.
7.4 AI Service Changes
AI features may depend on third-party providers, model availability, technical capacity, and applicable usage restrictions. We may reasonably modify or restrict AI functionality where necessary for security, legal compliance, provider changes, or service reliability.8. Financial Planning and Tracking Tools
My Digital Diary provides financial organisation, budgeting, savings tracking, debt management, and reporting features. These tools are intended for informational, record-keeping, and personal planning purposes. My Digital Diary does not provide regulated investment, banking, accounting, tax, or financial advisory services merely through these features. Financial calculations, estimates, projections, charts, and AI-generated recommendations may depend on information entered by users and may not reflect actual financial conditions. You should review financial information carefully before making significant decisions. You remain responsible for your personal financial decisions, except to the extent that liability is imposed on us by applicable law.9. Health and Wellbeing Tools
Health, diet, exercise, sleep, and wellbeing features are intended to assist with personal record-keeping and organisation. These features are not medical devices or professional healthcare services unless expressly identified and lawfully provided as such. They are not intended to diagnose, treat, cure, or prevent medical conditions. You should consult a qualified healthcare professional for medical concerns. Do not delay seeking necessary medical care because of information generated by the Service.10. Electronic Documents and Signatures
Where supported, My Digital Diary may provide features for preparing, storing, signing, or managing electronic documents. You are responsible for ensuring that you have the authority to sign a document and that its contents are lawful and accurate. The legal validity and enforceability of an electronic signature may depend on:- The applicable jurisdiction.

- The signatory's identity and intention.
- Applicable legal formalities.
- Any required certification or verification.
11. Subscription Plans and Free Trials
My Digital Diary may offer free and paid subscription plans. Certain features, storage limits, integrations, or AI functions may depend on the subscription plan selected. Before purchasing a paid subscription, the applicable purchase page should disclose:- The selected subscription plan.
- The applicable price and currency.
- The billing period.
- Applicable taxes or additional charges.
- Any available free trial.
- The trial expiry date, where applicable.
- Whether automatic renewal applies.
- The renewal price and billing frequency.
- How to cancel the subscription.
11.1 Free Trials
Where a free trial is offered, its duration, eligibility, limitations, and applicable conversion terms will be disclosed before activation. A trial will convert into a paid subscription only where the applicable purchase terms authorise that conversion. We will not impose undisclosed subscription charges or renewals.11.2 Automatic Renewal
Where a subscription is described as automatically renewing, it will renew according to the billing terms disclosed during purchase unless cancelled before the applicable renewal deadline. Where required by law, we will obtain appropriate authorisation for recurring charges and provide the necessary renewal notices and cancellation options.12. Payments and Billing
Payments may be processed through authorised third-party payment providers. These providers may impose their own terms, fees, verification requirements, and privacy practices. You agree to provide accurate billing information and use a payment method that you are authorised to use. A payment will be considered completed when the relevant payment confirmation has been received and recorded by the applicable payment system. If a payment is unsuccessful, delayed, reversed, or disputed, the related subscription may remain pending or become restricted, subject to applicable law. We will provide appropriate information about charges and payment status through supported channels. You should contact us if you believe a payment has been incorrectly processed.13. Cancellation, Refunds, and Subscription Expiry
13.1 Subscription Cancellation
Where automatic renewal is available, you may cancel future renewals using the available subscription management process or by contacting us. Unless otherwise required by law or stated in the applicable plan terms, cancellation of future renewal does not automatically terminate access for a period already paid for.13.2 Refunds
Refund eligibility depends on the applicable purchase terms, payment circumstances, and mandatory consumer protection laws. Where applicable law provides a right to cancel an electronic transaction or receive a refund, that right will take precedence over any conflicting subscription condition. Refund requests may be submitted to info@my-digital-diary.com . We will review eligible requests fairly and communicate the outcome and any applicable refund arrangements.13.3 Subscription Expiry
If your subscription expires or is not renewed, access to certain premium features may be restricted. Subscription expiry does not automatically mean that your account or stored information has been deleted. Data retention and deletion are governed by our Privacy Policy and applicable account deletion procedures.14. Acceptable and Fair Use
You agree to use My Digital Diary lawfully and responsibly. You must not:- Access or attempt to access another person's account without authorisation.
- Bypass authentication or security controls.
- Interfere with the normal operation of the Service.
- Upload malware, viruses, or malicious code.
- Use the Service to commit fraud or facilitate unlawful activity.
- Conduct unauthorised security testing or exploit vulnerabilities.
- Abuse APIs, automated functions, or system resources.
- Deliberately overload or disrupt the platform.
- Circumvent lawful subscription restrictions.
- Reverse engineer protected software where prohibited by applicable law.
- Infringe another person's intellectual property or privacy rights.
15. Third-Party Services and Integrations
Some My Digital Diary features may integrate with external services. These may include:- Calendar providers.
- Cloud storage providers.
- AI service providers.
- Payment providers.
- Email and notification services.
- Other authorised integrations.
16. Service Availability and Maintenance
We aim to provide a reliable, accessible, and secure Service. However, continuous and uninterrupted availability cannot be guaranteed. Temporary interruptions may occur because of:- Scheduled maintenance.
- Software updates.
- Internet connectivity failures.
- Hosting infrastructure problems.
- Third-party service failures.
- Cybersecurity incidents.
- Emergency repairs.
- Events beyond our reasonable control.
17. Backups and Data Preservation
Where backup services are enabled, we may maintain backups to support recovery, security, and continuity. Although we take reasonable measures to protect information, no electronic storage system can guarantee that data loss will never occur. Users should not rely on My Digital Diary as the only copy of irreplaceable documents or important records. Where export or backup features are available, we encourage users to maintain their own secure copies of particularly important information. Our backup and data retention practices are explained further in our Privacy Policy.18. Account Deletion
You may request deletion of your account through available account settings, including the Privacy & Data section, or by contacting us. Before deletion, we may:- Ask you to confirm your deletion request.
- Offer an opportunity to export eligible account information.
- Ask for optional feedback about your experience.
18.1 Deletion Grace Period
Under our standard deletion procedure, a confirmed account deletion request may initiate a 30-day grace period. During this period, the account may be marked for deletion and access may be restricted. Where supported, you may cancel the request before the deletion process is completed. Where applicable law requires a different or shorter deletion period, the legal requirement will take precedence.18.2 Permanent Deletion
After the applicable deletion period, eligible account information will be deleted from active systems in accordance with our procedures. Permanently deleted information may no longer be recoverable. Some limited records may be retained where required by law or reasonably necessary for security, fraud prevention, or legal claims. Backup information will be handled according to the relevant backup retention procedures.19. Intellectual Property Rights
The My Digital Diary application, software, design, branding, logos, interfaces, documentation, and original platform materials are protected by applicable intellectual property laws. Except for your own content, ownership of the Service and its proprietary elements remains with My Digital Diary or the relevant rights holders. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended lawful purposes. This licence does not transfer ownership of our software or intellectual property. You must not reproduce, distribute, commercially exploit, or create unauthorised derivative works from protected platform materials, except where permitted by law or authorised by us. Your personal User Content remains yours.20. Disclaimers and Service Limitations
My Digital Diary is intended to support personal organisation, planning, productivity, and record-keeping. We do not guarantee particular financial, medical, educational, professional, productivity, spiritual, or personal outcomes. To the extent permitted by applicable law, the Service is provided on an "as available" basis. We do not guarantee that every feature will always operate without interruption, error, or compatibility problems. Nothing in this section excludes express commitments we have made to you or statutory guarantees that cannot legally be excluded.21. Limitation of Liability
To the maximum extent permitted by applicable law, My Digital Diary will not be liable for indirect, incidental, special, or consequential losses arising from use of the Service where such liability may lawfully be excluded. Examples may include losses arising solely from:- Inaccurate information entered by a user.
- Decisions made in reliance on AI-generated suggestions without appropriate verification.
- Independent third-party failures outside our reasonable control.
- Problems caused solely by a user's device or internet connection.
- Unauthorised changes made by the user.
22. Suspension and Termination
We may temporarily suspend or terminate access where reasonably necessary because of:- Serious violations of these Terms.
- Fraudulent or unlawful activities.
- Security threats.
- Unauthorised access attempts.
- Significant abuse of system resources.
- Repeated misuse after appropriate warnings.
- Applicable legal or regulatory requirements.
23. Changes to the Service or These Terms
We may update the Service and these Terms from time to time. Changes may be made to reflect:- New application features.
- Improvements to existing tools.
- Changes in technology.
- New legal or regulatory obligations.
- Security requirements.
- Changes to third-party integrations.
- Operational improvements.
24. Governing Law and Dispute Resolution
These Terms are governed by the applicable laws of the Republic of Uganda, subject to mandatory protections available under other laws that apply to individual users. If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter fairly and promptly. You may submit a complaint to: info@my-digital-diary.com . Where a dispute cannot be resolved informally, the competent courts or other legally authorised dispute resolution bodies may determine the matter in accordance with applicable law. Nothing in these Terms prevents a consumer from using a legally available complaint mechanism, regulatory authority, or court with mandatory jurisdiction.25. International Users
My Digital Diary may be accessible from countries outside Uganda. Users are responsible for complying with applicable local laws when using the Service. Certain features, payment options, AI providers, or integrations may be unavailable or restricted in particular jurisdictions. Where mandatory consumer protection or data protection laws apply, those requirements will not be overridden by these Terms.26. Electronic Communications
By creating an account, you acknowledge that communications relating to your use of the Service may be delivered electronically, subject to applicable law. These may include:- Account verification messages.

- Subscription confirmations.

- Service-related announcements.
- Material changes to these Terms.
